Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legal agreement between you and Manpreet Singh ("we," "us," "our") governing your access to and use of FastGeo (the "Service"), including our geocoding API, website at fastgeo.net, and any related services.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Who May Use the Service

Age Requirement: You must be at least 16 years old to use the Service.

Capacity: You must have the legal capacity to enter into a binding contract.

Business Use: If you use the Service on behalf of an organization, company, or entity, you represent and warrant that you have the authority to bind that entity to these Terms, and all references to "you" include that entity.

3. Account Registration

Account Creation: To use certain features, you must create an account by providing accurate and complete information, including your name and email address.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at visifan.co@gmail.com.

Account Accuracy: You agree to keep your account information current and accurate at all times.

4. API Keys and Authentication

API Key Generation: Upon registration, you may generate API keys to access the Service programmatically.

Key Security: You are responsible for keeping your API keys confidential and secure. Do not share API keys in public repositories, client-side code (unless protected with domain restrictions), or unsecured environments.

Key Restrictions: You may configure domain restrictions, IP whitelisting, and rate limits for each API key through your account dashboard. You are responsible for properly configuring these security settings.

Key Revocation: You may revoke API keys at any time. We may revoke or suspend API keys if we detect suspicious activity or violations of these Terms.

Responsibility: You are responsible for all activity that occurs using your API keys, whether authorized or unauthorized.

5. Service Description

FastGeo provides a geocoding API service that allows you to convert addresses to geographic coordinates (forward geocoding) and coordinates to addresses (reverse geocoding). The Service normalizes and serves data sourced from third-party providers. We do not create or guarantee the underlying source data.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service to transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Bypass or circumvent any security measures, rate limits, or usage restrictions
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to build a competing product or service
  • Resell, redistribute, or sublicense access to the Service without written permission
  • Submit false, misleading, or fraudulent information
  • Use the Service in a manner that could damage, disable, or impair the Service
  • Use automated tools to scrape or harvest data from the Service beyond normal API usage
  • Share or publish your API keys publicly
  • Use the Service for spam, harassment, or malicious activities

7. Subscription Plans, Pricing, and Billing

Free Tier: We offer a free tier with limited daily requests as specified on our pricing page.

Paid Plans: Paid subscription plans are available with higher usage limits. Current plans and pricing are displayed at fastgeo.net and may be updated from time to time.

Billing: Subscriptions are billed on a recurring basis (monthly or annually as selected). Payments are processed securely by our payment processor, Stripe. By subscribing, you authorize us to charge your payment method.

Metered Billing: Some plans include metered billing for usage beyond included limits. Overage charges are calculated and billed according to the rates displayed on your subscription plan.

Payment Information: You are responsible for providing accurate and current payment information. If payment fails, we may suspend or terminate your access to paid features.

Price Changes: We reserve the right to modify pricing with at least 7 days' notice. Changes may affect your current billing period and will take effect on your next billing cycle or after the notice period, whichever is later.

Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying.

8. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of that period.

No Refunds: Subscription fees are non-refundable except as required by law. We do not provide refunds or credits for partial months or unused service.

Termination by Us: If we terminate your account for violation of these Terms, you will not receive a refund.

9. Usage Limits and Rate Limiting

Request Limits: Each plan includes specific daily or monthly request limits as specified on your plan details.

Rate Limits: API requests are subject to rate limiting to ensure fair usage and service stability. Current rate limits are displayed in your account dashboard and API documentation.

Exceeding Limits: If you exceed your plan's included usage, additional charges may apply based on your plan's overage rates. We may also temporarily throttle or suspend access if limits are repeatedly exceeded.

Fair Use: Even on unlimited or high-volume plans, we reserve the right to enforce fair use policies to prevent abuse.

10. Service Availability and Modifications

Availability: While we strive to provide reliable and uninterrupted service, we do not guarantee that the Service will always be available, error-free, or free from delays, disruptions, or defects. No uptime guarantee or SLA is provided unless separately agreed in writing.

Maintenance: We may perform scheduled or emergency maintenance that temporarily interrupts service. We will provide advance notice when possible.

Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will provide reasonable notice for material changes that negatively impact functionality.

Updates: We may update the Service to add features, fix bugs, or improve performance without notice.

11. Your Content and Data

Ownership: You retain all rights, title, and interest in the data you submit to the Service (e.g., addresses, queries).

License to Us: By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and transmit your data solely to provide and improve the Service, ensure security, and comply with legal obligations.

Caching: The Service caches geocoding results to improve performance and reduce costs. Cached results may be shared across users for identical queries.

Data Deletion: You may delete your account and associated data at any time through your account dashboard.

12. Intellectual Property

Our Rights: The Service, including all content, features, functionality, software, code, design, graphics, and trademarks, is owned by Manpreet Singh and is protected by international copyright, trademark, and other intellectual property laws.

Restrictions: You may not copy, modify, distribute, sell, or create derivative works based on the Service without our express written permission.

Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without restriction or compensation.

13. Third-Party Services

The Service integrates with third-party services, including:

  • Stripe for payment processing
  • Google reCAPTCHA for form protection

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

14. Termination

By You: You may stop using the Service and delete your account at any time.

By Us: We may suspend or terminate your access to the Service immediately without notice if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is involved in fraudulent, abusive, or illegal activity
  • We are required to do so by law
  • We cease operating the Service

Effect of Termination: Upon termination, your right to use the Service immediately ceases. We may delete your account data in accordance with our Privacy Policy. Outstanding fees remain due.

Survival: Sections of these Terms that by their nature should survive termination will survive, including provisions regarding intellectual property, disclaimers, limitations of liability, and governing law.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors or defects will be corrected

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MANPREET SINGH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any other matter relating to the Service

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Manpreet Singh and our affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws

18. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection laws provide otherwise.

Informal Resolution: Before filing a claim, you agree to contact us at visifan.co@gmail.com to attempt informal resolution.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, by sending you an email notification or displaying a prominent notice in the Service.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

20. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
